Avrupa Birliği’ne tam üyelik sürecinde Türkiye, sosyal güvenlik
politikaları alanında da Avrupa’dan bağımsız düşünülemez. Sosyal güvenlik
boyutuyla, müzakere sürecinin önemli fasıllarından biri olan 2 sayılı Kişilerin
Serbest Dolaşımı her geçen gün önemi ve ağırlığı artan ulusal ve uluslar üstü
uyumu zorunlu kılan bir sisteme dönüşmüştür. Türkiye'nin bu kapsamda sayılan
yönergelere uyumu konusunda sorunlar karşımıza çıkmaktadır. Küreselleşen
dünyada sosyal güvenlik haklarının transferlerinden serbest dolaşıma kadar birçok
konu ortada durmaktadır. Bu da Türkiye’nin tam üyelik sürecinde önemli bir
adımdır.
AB ile Türkiye arasında imzalanan Ankara Antlaşması (1963) ve Katma
Protokol (1970) maddeleri uyarınca, 1986 yılı başından beri serbest dolaşımın
başlaması ve serbest dolaşım haklarından yararlanan işçilerin sosyal güvenliğinin
sağlanması hedeflenmiştir. Bu konudaki görüşmeler değişen koşullar nedeniyle
zaman zaman kesintiye uğramıştır. AB üyesi ülkelerde üç milyonu aşan Türk
işgücü ve ailelerinin mevcut sosyal güvenlik hakları yeterli olmasa da, Ortaklık
Konseyi kararları ve protokollerle kısmen kazanımlar sağlanmıştır. İşçilerin
sosyal güvenlik hakları ve bu hakların transferleri gibi konular, Türk Sosyal
Güvenlik Sistemi’nin AB’ye uyumunu zorunlu kılmaktadır. Bunun için 19 sayılı
Fasıl görüşmelerine bir an önce başlanması ve karşılıklı eşgüdümü sağlayacak
teknolojik ve yönetimsel alt yapının kurulması önem taşımaktadır.,
Turkey that has full membership process to the European Union can not be
considered independent from Europe in the field of social security policies.
Within the social security dimension, Free Movement of Persons No. 2 which is
one of the important chapters of the negotiation process, has become a system that
necessitates national and transnational cohesion which is increasing in importance
and weight. Turkey has encountered problems in complying with the guidelines
mentioned in this context. In the globalized world, there are many issues ranging
from transfers of social security rights to free movement. This is an important step
in the process of Turkey's full membership.
According to Ankara Agreement (1963) progressively signed between the
EU and Turkey and the provision of Additional Protocol (1970), it is aimed to
start free movement and to ensure the social security of workers benefiting from
free movement since the beginning of 1986. Negotiations on this issue were
interrupted from time to time due to changing conditions. Although the existing
social security rights of the Turkish labor force and their families exceeding three
million in the EU member countries are not sufficient, some gains have been
achieved through Association Council resolutions and protocols. The social
security rights of workers and the transfer of these rights necessitate the
harmonization of the Turkish Social Security System with the EU. For this, it is
important to start the negotiations of Chapter 19 as soon as possible and to
establish a technological and managerial infrastructure that will ensure mutual
coordination.
