Bu çalışma bildirilmeyen iş kazaları üzerinedir ve bu sorunun çözümüne odaklanmaktadır. Nitel araştırma yöntemlerinden yüz yüze yarı yapılandırılmış derinlemesine görüşmelere dayalı çalışma kapsamında Giresun ilinde, 2013-2019 yılları arasında iş kazası geçiren 10 çalışanla görüşme yapılmış ve bu kişilerin geçirdikleri iş kazalarının bildirilmeme sebepleri tasnif edilmeye çalışılmıştır. İş kazası geçiren görüşmecilere kartopu örneklem yöntemiyle ulaşılmıştır. Görüşülen 10 çalışan toplamda 16 iş kazası geçirmiştir ve bu kazalardan yalnızca bir tanesinin bildiriminin yapıldığı anlaşılmıştır. Diğer bir deyişle, 15 iş kazasının hem işveren hem de hastanelerce bildiriminin yapılmadığı tespit edilmiştir.
İş kazalarının bildirimini engelleyen sebepler üç başlık altında toplanmaktadır. Bunlar; kazazededen kaynaklı sebepler, sağlık hizmet sunucusundan (sağlık personellerinden) kaynaklı sebepler ve işverenden/ işveren vekilinden kaynaklı sebeplerdir. Çalışmamızda kazazededen kaynaklı sebeplerin de birinci derecede sorumlusunun işverenler olduğu anlaşılmıştır.
İş kazalarının bildirilmesini engelleyen kazazeden kaynaklı sebepler şunlardır: İşten çıkartılma korkusu, mobbinge uğrama korkusu, iş kazası sonucunda oluşan sağlık problemini önemsememesi, iş kazasının bildirim prosedürlerini bilmemesi, iş kazasının tanımını bilmemesi, iş kazasının meydana gelmesinde kendini suçlu hissetmesi, adli ve hukuki prosedürlerden kaçınması ve nihayet işverenini/ işveren vekilini idari ve cezai yaptırımlardan koruması.
Sağlık personeli kaynaklı sebepler ise şunlardır: İş kazası geçirdiğini ifade eden çalışanlarla ilgili gerekli işlemleri yapmaması, kazazedenin talebi doğrultusunda iş kazası kaydı oluşturmaması.
İşveren/ işveren vekili kaynaklı sebepler ise şunlardır: Kazazedeye baskı yapması, idari ve cezai yaptırımlardan kaçınması.
Bildirimi yapılan iş kazasında ise kazazedeye, iş kazası ve meslek hastalığı sigortasından sağlanacak yardımların olduğu bilgisinin verilmesi ve kurum çalışanlarının kazazedeye iş kazasını bildirmesi yönündeki tavsiyelerinin etkili olduğu anlaşılmıştır.
This research is about the unreported work accidents and focuses on the solution of this problem. Using face to face semi-structured deeply interview, which is one of the qualitative research method, 10 employees who had work accidents have been reached and interviewed in Giresun between the years 2013-2019 and the reasons for their unreported accidents have been tried to be classified. These employees are reached using snowball sampling method (technique). The number of work accidents of these 10 employees is 16, but only 1 of these 16 has been reported. It has been determined that 15 work accidents have been reported by neither the employers nor the hospitals.
The reasons preventing reporting work accidents are gathered under three headings: the casualty’s, the medical personnel’s or the employer’s/ employer representative’s excuses. In our research, it is understood that the excuses of the casualty’s are also arisen from the employers’ responsibility at first.
The reasons of a casualty’s not reporting the work accidents are: casualty’s; fear of becoming unemployed, fear of sustaining mobbing, not considering the health problems caused by the work accident, not knowing the reporting procedures of work accidents and the definition of a work accident, blaming himself for work accident, abstaining from the judicial and legal procedures, at last trying to protect his employer or employer representative from administrative and penal sanctions.
The reasons of medical personnel’s not reporting the work accidents are: not doing the necessary process of the casualty that conveys his having work accident and the medical personnel’s not checking in work accident upon casualty’s request.
The reason of employer or employer representative’s not reporting the work accidents is their avoiding from administrative penalty and punishment by pressuring on casualty not to report.
In the one reported work accident, it is understood that giving information to a casualty about the availability of assistance from occupational accident and occupational disease insurance and the company employees’ recommendations to casualty about reporting the work accident have been effective.
