Bu çalışma, XIX. yüzyılda, Osmanlı Devleti ve toplumunda içkiye yaklaşımı ve
içki (müskirat) yasaklarını arşiv belgeleri ışığında incelemek amacıyla
hazırlanmıştır. Osmanlı Devleti’nde özellikle Tanzimat Fermanı sonrasındaki
değişim ve dönüşüm sürecinde, klasik döneme göre oluşan farklılaşmalar ve içkiye
yönelik uygulanan yasaklar ele alınmıştır. Bu yasaklardan hareketle konuya birçok
yönden açıklık getirilmeye çalışılmıştır: Sosyo-kültürel açıdan yapılan
değerlendirmede Osmanlı Devleti’ndeki içki mekânları, mekânların kapatılma
sebepleri, ‘kamusal alan’a yapılan vurgu, Müslüman ve gayrimüslim ahalinin
şikâyetleri ele alınmıştır. İçki düzenlemeleri ve yasakları üzerinden Avrupa
devletlerinin Osmanlı Devleti üzerinde -kendi tebaaları ve Osmanlı tebaası olan
gayrimüslimlerin hamisi sıfatıyla- ekonomik, siyasi, kültürel yayılımları ile
kendilerine manevra alanı yaratmaya çalışmaları incelenmiş, Devlet’in baskılar
dolayısıyla aldığı tedbirler ve uyguladığı yaptırımlara yer verilerek konuya siyasi
bakımdan açıklık getirilmiştir. Ayrıca, konunun ekonomik boyutu ele alınarak içki
üretim ve satışından alınan vergiler, serbest ticaret antlaşmaları vasıtasıyla Osmanlı
ekonomisine müdahaleler, Düyun-ı Umumiye İdaresi ile olan bağlantılara vurgu
yapılmıştır. Aynı zamanda konunun dini boyutu irdelenmiş, ‘İslam toplumu ve
devleti’ kimliğinin muhafazasını temel alarak, İslam dinince içki üretim- kullanımsatış hakkının Müslümanlara yasaklanıp gayrimüslimlere serbest bırakılması
bağlamında Devlet’in uygulamaları ortaya koyulmuştur. Hukuki yönden ise kanun
ve nizamnameler ile cezai yaptırımlar incelenmiştir. Devletin defaatle yürürlüğe
koyup kaldırdığı, çeşitli nedenlerle hedefine ulaşamadığı yasaklar ile bu süreçte
uygulanan siyasi ve hukuki yaptırımların devletin merkeziyetçi yapısının
korunmasına olan etkisi üzerinde durulmuştur.
This study is prepared in order to analyze the approach towards alcoholic
beverages and prohibition of these beverages in the Ottoman Empire and society
in 19th century, in the light of the archive documents. In this century, especially the
differentiations which occured during the process of change and transformation
after the Rescript of Gülhane were dealt with in relation to the alcoholic beverages.
The prohibitions which were enforced at times in this process were analyzed in
detail so the issue was clarified. The public houses in the Ottoman Empire, the
reasons for their having been closed, the emphasis on “public space” and the
complaints of Muslim and Non-Muslim people which they stated because of
different reasons, were dealt with and the socio-cultural dimension of the issue was
evaluated. The European States wanted to expand economically, politically and
culturally by using the prohibition of alcohol and they tried to create a room for
maneuver for themselves in the Ottoman domestic politics qua the protector of their
citizens and non-muslim citizens who were the citizens of the Ottoman Empire. The
state had taken measures, especially the Rescript of Gülhane, because of the
pressures, and there were some enforcements ruled by the state. All of these facts
above are included in this study so as to analyze the issue according to the politics.
Furthermore, the alcoholic beverage taxes, the interventions to the economy of the
Ottoman Empire through free trade agreements and the relations with the Düyun-ı
Umumiye(Public Debts) are dealt with, which enabled to analyze the economic
dimension of the issue. Besides, the identity of “Islam society and state” which is
the main reason of the prohibitions, was protected and the right for producing and
consuming alcoholic beverages was prohibited for Muslims whereas it was free for
non-muslims. These facts are also included in this study in order to analyze the
issue in terms of religion. The prepared laws and regulations and the penal
sanctions are also included in order to analyze the issue in detail in terms of law.
The prohibitons which the state had enforced time and again and which could not
accomplish its purpose because of several reasons and how the political and legal
enforcements in this process affected the protection of the state’s centralist body
are also emphasized.
