624 Numaralı Ayniyat Defterine (H.1266-1271 / M. 1850-1855) Göre Osmanlı Devleti’nde Suçlar ve Cezalar (Değerlendirme ve Metin)

Abstract

Dünya tarihinin gelmiş geçmiş en büyük devletlerinden olan Osmanlı Devleti bu büyüklüğü ve gücünü kurmuş olduğu devlet sisteminden almıştır. Bu sistem içerisinde neler olduğunu ve nasıl işlediğine dair bilgileri sunan Osmanlı arşivleri de dünya tarihi açısından güzide bir noktadadır. Osmanlı arşivi içerisinde pek çok belge fonu ve bu fonların içerisinde yer alan defter serileri mevcuttur. Ayniyat defter serileri de bu fonların içerisin’de yer alarak Bab-ı Ali evrak odasında bulunmaktadır. Şüphesiz ki Bab-ı Ali Evrak odası Osmanlı arşivinin en önemli fonlarından bir tanesidir. Ayniyat defteri serileri içerisinde yer alan 624 numaralı ayniyat defteri kürek cezasına dair hükümleri ihtiva etmektedir. Çalışmamız 624 numaralı Ayniyat defteri çerçevesinde hazırlanmıştır. Suçlar ve cezalar olarak incelenen bu çalışma içerisinde ilk bölümde suçlar ikinci bölümde ise bu suçlara uygulanan cezalar anlatılmıştır. Defter kürek cezasına dair yazılmış olsa da içerisinde kürek cezasının haricinde pranga cezası, sürgün cezası ve hapis cezası da bulunmaktadır. Bu cezaların haricinde ıtlak (af) edilme hükümleri de mevcuttur.

The Ottoman Empire, which is one of the greatest empires of the history of the world and which has existed for more than 600 years, certainly owes this sublimity to the state system which established by himself. The Ottoman archives, which provide information about what is in this system and how it works, is also a remarkable point in terms of world history. There are many document funds in the Ottoman archives and book series which are included in these funds The Ayniyat Register series are also included in these funds and are located in the documentary room of Bab-i Ali. There is no doubt that Bab-i Ali document room is one of the most important funds of the Ottoman archives. The Ayniyat Register numbered 624 which takes part in the Ayniyat Register series contains provisions for penal servitude. Our study was prepared within the scope of the Ayniyat Register numbered 624. In this thesis, which is examined as crime and punishment, crimes are explained the first section and the penalties applied to these crimes are explained in the second section. Although the register is written about the penal servitude, there is also shingle penalty, exile penalty and imprisonment penalty. Apart from these punishments, there are provisions for forgiveness.
