ʺEcânibin Memâlik-i Osmâniyyeʹde Haʹiz Oldukları İmtiyâzât-ı Adliyyeʺ Adlı Eserin Tahlil ve Transkripsiyonu

Abstract

Osmanlı Devleti'nin yabancı devletlere vermiş olduğu kapitülasyonlar, Osmanlı Tarihi'nin önemli konuları arasında dikkat çekmektedir. Osmanlı Devleti ile ahidnâme imzalayan devletlerden herhangi birine tabi olan kişiler, Osmanlı sınırları içerisinde ticarî, iktisadî, hukukî, dinî pek çok konuda ayrıcalıklar elde ederek avantajlı duruma geliyorlardı. Ecnebî olarak adlandırılan kişilere verilen bu imtiyazlar, zaman içerisinde Avrupalı devletlerin de baskıları sebebiyle olumsuz sonuçlara neden olmaktaydı. Özellikle XIX-XX. yüzyılda Osmanlı Devleti'nde, hukukî açıdan ortaya çıkan sonuçları ve yansımaları önem arz etmektedir. Çeviriyazısı gerçekleştirilen Ecânibin Memâlik-i Osmâniyyeʹde Haʹiz Oldukları İmtiyâzât-ı Adliyye adlı eser de bu konu hakkında ayrıntılı bilgiler sunmaktadır. Eserin ağırlık noktası, Osmanlı Devletiʹnin ecnebîlere vermiş olduğu hukukî ayrıcalıklardır. Osmanlı Devletiʹnde ecnebîlere verilen hukukî ayrıcalıkların yanı sıra kapitülasyonların tarihi seyri hakkında da ayrıntılı bilgiler sunmaktadır. Yapılan bu çeviriyazı neticesinde ecnebîlerin elde etmiş olduğu hukukî ayrıcalıklar ortaya konulmaya çalışılmıştır. Ayrıca Ecânibin Memâlik-i Osmâniyyeʹde Haʹiz Oldukları İmtiyâzât-ı Adliyye adlı eseri kaynak olarak kullanan araştırmacılar da tez içerisinde belirtilerek değerlendirilmesi yapılmaya çalışılmıştır.

The capitulations given by the Ottoman Empire to the foreign states are among the remarkable topics of Ottoman History. People that are subject to states which has signed ahidname with Ottoman Empire came to privileged position in many aspects of commercial, economic and juristic matters within the borders of Empire. In time concensions given to foreign people called foreign, were causing negative impacts with increasing pressure by European goverments. These concessions granted to foreign by Ottoman Empire have always been important subject of discussion. Furthermore, consequences and reflections in XIX-XX. century especially in legal aspects of these concessions also has an importance. For this reason Ecânibin Memâlik-i Osmâniyyeʹde Haʹiz Oldukları İmtiyâzât-ı Adliyye was transcribed. The major point of the work is the legal privileges granted by the Ottoman Empire to the foreign citizens. In this context, there are very important subjects of concessions obtained by foreign citizens. Legal concessions obtained are revealed by this transcription study. The work provides detailed information on the historical progress of the capitulations, especially on the legal privileges. In addition, researchers who used the mentioned work as a reference have been evaluated and pointed out in the thesis.
