Fıkıh literatüründe kefaet olarak ifade edilen evlilikte denkliğin şart olup olma-dığı konusunda ihtilaf edilmiştir. Evlilikte denklik şartı müçtehid imamlar döne-minden sistemleştirilerek ayet ve hadisler ışığında örfün de etkisiyle bazı kriter-ler belirlenmiştir.
