| dc.description.abstract | İslam Medeniyetinin kök salıp gelişmesinde aile kurumu her daim mühim vazife ifa etmiştir. Madde ve mananın en mükemmel tarzda meczedildiği sistemlerin başında gelen İslam medeniyetinde aile hususunda ideal olanın yanında rasyonalite de ihmal edilmemiş, yaşamın gerçekleri dikkate alınarak hukuki düzenlemeler vaz edilmiştir. Zamanla Kur'an sünnet ve icmaya dayanan zengin bir hukukî literatür ortaya konmuştur. Aile hukuku konuları, klasik dönem fıkıh kitaplarında muamelat konuları arasında değerlendirilirken XIX. yüzyıdan itibaren bu alanda bir takım yenilikler yapılmıştır. Avrupa’da başlayan kanunlaştırma hareketlerinin İslam dünyasına da sirayet etmesiyle birlikte aile hukuku kapsamına giren konular el-ahvâlü’şşahsiyye adıyla anılmaya başlanmıştır. Bu konular ilk olarak Osmanlı Devleti tarafından Tanzimat’ın ilanı ile birlikte Hukûk-i Âile Kararnâmesi adıyla kanunlaştırılmıştır. İslam dünyasındaki kanunlaştırma hareketleriyle birlikte hukuk sistemleri laikleşme sürecine girmiş ve aile hukuku konuları ahvâl-i şahsiyye başlığı altında ayrı bir hukuk dalı olarak birçok İslam ülkesinde kesintiye uğramadan uygulanmaya devam etmiştir. Nitekim Müslüman âlimlerin asırlar boyu süren katkıları neticesinde şekillenen ahvâl-i şahsiyye literatürü içerisinde aile hukuku konuları etraflıca ele alınmıştır. Dolayısıyla bu çalışmada, ahvâl-i şahsiyye alanında yazılan eserler incelenerek muhtevasının neler olduğu tespit edilmeye çalışılmıştır. | en_US |
| dc.description.tableofcontents | The institution of the family has always played an important role in the root and development of the Islamic civilization. In the Islamic civilization, which is one of the leading systems where matter and meaning are consecrated in the most perfect way, rationality was not neglected in addition to the ideal in terms of family, and legal arrangements were made by considering the realities of life. In time, a rich legal literature based on the Qur'an sunnah and ijma was put forward. While family law issues are considered among the modal issues in the classical period fiqh books, XIX. since the century a number of innovations have been made in this field. As the codification movements that started in Europe spread to the Islamic world, the subjects within the scope of family law started to be called as “personal status”. These issues were first enacted by the Ottoman State as the Family Law Decree with the declaration of the Tanzimat. With the legalization movements in the Islamic world, legal systems entered the process of secularization and family law issues continued to be applied as a separate branch of law under the title of personal status without interruption in many Islamic countries. As a matter of fact, family law issues have been discussed in detail in the personal status literature, which has been shaped as a result of the contributions of Muslim scholars for centuries. Therefore, in this study, it has been tried to determine the content of the works written in the field of personal status. | en_US |
